We have arrived at a degree of knowledge sufficient at least to teach us that the business of production and interchange requires no aid from the law ; that a man may be left to grow wheat and barley, to manufacture cloth, to deal in hats and hosiery, as he pleases, and to sell them at what prices he can obtain, without the necessity of the governing power watching his steps to prevent him from sacrificing his interest, or from reaping extraordinary profits in consequence of the supinenessof his fellow men.

The only purpose for which the State can interfere in these matters with advantage, is to uphold good faith and protect him and those with whom he deals from mutual injury. For this end, payments, contracts, and promises are enforced. There are certain prescribed modes in which he can extort the money that is wrong-fully withheld, and compel the fulfilment of the bargain which any one endeavours to evade. But there are no laws to save him from imprudence, none prescribing what capital he shall have, or what proportion it shall bear to the amount of business transacted, or what profits he shall make ; none limiting the number of his offices and warehouses and factories, or fixing the towns and seaports where they shall be situated. Regulations of this sort would be manifestly ill-judged, burdensome, and unnecessary. Such points are to be determined by the vigilance of the party concerned requiring minute knowledge of a thousand particulars which will be learned by nobody but him who has an interest in knowing them; and, although they are not invariably determined with perfect wisdom, are determined more wisely on this plan than they could be on any other.

C'est intéressant, mais cette idée avait déjà été discutée antérieurement par d'autres, notamment Turgot (et Gournay) :

 

"Turgot goes on once more to the "Hayekian" theme of greater knowledge by the particular actors in the market. The entire laissez-faire doctrine of Gournay, he points out, is grounded on the "complete impossibility of directing, by invariant rules and continuous inspection a multitude of transactions which by their immensity alone could not be fully known, and which, moreover, are continually dependent on a multitude of ever changing circumstances which cannot be managed or even foreseen".

Remplacer cette force instinctive, spontanée, toujours agile, qui s'appelle la spéculation, la bienfaitrice et la conservatrice du genre humain, par le mécanisme encombrant, lourd, tardif, de la comptabilité et de la statistique, c'est une prétention qui ne tient pas compte de ce que parmi les besoins humains il en est qui ne peuvent attendre. Schœffle décrit assez exactement les objets principaux de la spéculation sur les marchandises : « 1° Détermination sociale du total des besoins pouvant être satisfaits par des produits économiques ; 2° détermination de la quantité et de la qualité demandées des productions qui sont du ressort économique ; 3° production continue d'une valeur d'échange qui maintient l'équilibre économique de la production et de la consommation... ». Mais l'auteur socialiste oublie que pour remplir cette fonction complexe, dont il fait une analyse qui n'est que partielle, la spéculation a des moyens qui sont bien supérieurs à la comptabilité et à la statistique. Le rôle essentiel de la spéculation, c'est de proportionner partout les produits aux besoins de consommation ou du moins aux facultés de payer. La comptabilité et la statistique sont bien un de ses moyens d'information, mais ce n'est pas le plus rapide et le plus décisif, celui-ci est le prix. Dès que le prix a donné ses indications irrécusables, la spéculation est mise en branle avec une prodigieuse rapidité d'efforts et de mouvements par l'intérêt personnel surexcité. Sans le prix et sans l'intérêt personnel, toutes les comptabilités et toutes les statistiques du monde sont des documents presque inutiles.
